Board discusses appeal to circuit court after remand; scheduling conference set

Board members used the other-business portion of the meeting to discuss a pending administrative appeal that has been filed in Sawyer County Circuit Court. Board members said a recent decision that remanded an item back to the zoning committee was appealed within the 30-day window; the appeal now sits in circuit court and a scheduling conference is set for Oct. 13 (date noted by staff). The party who filed for a temporary restraining order did not obtain that injunction.

Members expressed frustration about incomplete notification to the board and to parties when the appeal was filed and said the zoning committee had not re-heard the remanded item because the appeal was pending. Several members raised that earlier meeting audio was unclear and that the minutes required correction; staff previously adjusted minutes, and the appellate filing challenges whether the board had authority to remand the matter to the zoning committee. Counsel and staff said the normal practice following a circuit-court appeal is to await the court’s ruling; if the court remands the case back to the board or zoning committee, staff said the county would hold a de novo hearing and would summon relevant witnesses and prior participants to testify.

Board members asked for staff to keep the board informed of court scheduling and outcomes; legal counsel confirmed the appeal was filed within the applicable period and that the court did not grant the requested restraining order. Members asked staff to improve notification procedures so board members and affected parties receive timely notice of filings and court dates. The board will receive updates from legal counsel as the circuit-court matter proceeds.
