Magistrate Don Wynn recommended City Council not reduce a large enforcement lien on 508 Lucky Street after reviewing the file and finding the applicant absent from the hearing.
City staff summarized the enforcement history dating back to 2007, including multiple hearings, a dangerous-structure finding in 2019, a council-authorized demolition on May 13, and daily fines that accrued. Staff said the total fines and costs amounted to approximately $159,151 and that the applicant sought a reduction of roughly $155,500.
No representative for the applicant appeared at the lien-reduction hearing; staff noted the applicant had acknowledged receipt of the hearing notice on July 11 and that the husband/business partner, Mr. Burse, had contacted staff. The magistrate said he reviewed documentary evidence and photos, found no mitigating circumstances that would justify a reduction and recommended that City Council deny the reduction request so the lien stands. "I will recommend that city council not reduce this lien," Wynn said.
The magistrate's written recommendation will be mailed to the parties and placed before City Council; the applicant may appear at the council meeting to address the recommendation.
