Magistrate Don Wynn recommended that city council reduce a code-enforcement lien on property at 195 Roosevelt Street (original lien about $13,100) to $1,000 plus $216.58 in city costs.
City staff said the original charges were for dead trees and debris. The enforcement history shows a request for a lien reduction was presented to City Council on March 11, 2025, but staff later determined the property had been sold to Sky Investments on March 6, 2025 — before the reduction request — meaning the earlier requester lacked standing. Sky Investments subsequently re-applied for a reduction and told staff it had since cleared underbrush and removed dead trees.
Vern Daniels, who identified himself as the current owner, told the magistrate he had cleaned the lot after buying it and said he was unaware of the prior lien at the time of purchase. City staff confirmed the $216.58 city cost remains unpaid. The magistrate cited factors including the gravity of the original violation, corrective work completed by the current owner, market value and equitable circumstances in recommending a reduction to $1,000 plus the city costs. "I will recommend that city council reduce this lien to $1,000 based on several factors," Don Wynn said.
Wynn said the written order will be a recommendation for City Council; the applicant will receive notice and may speak at the council meeting where that recommendation is considered. The magistrate’s ruling instructs staff to include the $216.58 in the amount owed.
