The Mitchell Planning Commission recommended approval of a rezoning request for property at 2635 Anthony Avenue and approved a related ordinance amendment to remove that parcel from the CJM Second Edition planned unit development.
Planning staff said notices were posted and that a small number of responses were received; nearby parcels on the south side already carry urban development zoning. The applicant seeks rezoning of the north parcel (currently PUD) to match contiguous urban development zoning so the three parcels can later be replatted as a single lot for tax reasons.
Staff described the rezoning as contiguous and not spot zoning, and said the change would allow the owner to replat the parcels because current mixed zoning prevents consolidation. “He's requesting to have it rezoned so that way he can come back and replat all three parcels into one parcel,” the staff member said.
The commission moved and seconded recommendation of approval for the rezoning; no members of the public addressed the item and the motion carried on a voice vote.
Because the parcel sits inside the CJM Second Edition PUD, staff brought a separate ordinance amendment to remove the parcel from the PUD if the rezoning is approved. Staff described the ordinance as “cleanup” tied to the rezoning and noted the legal description is in the packet. The amendment was moved, seconded and approved on a voice vote.
