The Fox Chapel Area School District board on Oct. 13 debated whether to pursue a policy change to the board vacancy appointment process after the legislation and policy committee presented revised board operations guidelines.
Several board members expressed interest in expanding the public process for filling a board vacancy so that the board would interview candidates in one meeting and allow a subsequent meeting for public input and deliberation before voting. Members raising the issue said the current practice of interviewing and voting in a single meeting can limit public awareness and compress board deliberation.
The board's solicitor, Mr. Dufres, advised that the principal statutory constraint is a 30‑day deadline to appoint someone to a vacancy; if the board fails to act within that time, the matter can be referred to the court of common pleas. He also noted that meeting notice requirements (advertising/notice in accordance with the Sunshine Act and local newspaper publication practices) impose additional timing constraints.
Board discussion referenced operational considerations such as the seven‑day advance notice typically used for advertised meetings, the scheduling cadence of the board and the need for a quorum (five members) for an appointment vote. Members said a committee review could return recommended language to the board for consideration; the board passed the operating-guideline revisions as presented and asked the committee to consider whether a formal policy change to the vacancy process should be proposed for future action.
No immediate policy change to the vacancy timeline was adopted at the Oct. 13 meeting; the board asked the governance committee to consider proposals and possible questions for candidate interviews during committee review.
