Commissioners asked county staff to research what legal authority Leon County has, if any, to act regarding alleged burial grounds at the Capital City Country Club property after a public speaker raised concerns about graves believed to be on the site.
Commissioner Cummings moved, and the board approved, a request for the county attorney and county administrator to provide a written analysis of statutory authority, including how a county could act if a cemetery within a municipal jurisdiction is abandoned or not reasonably maintained. The county attorney previewed the statute on cemeteries: a county or municipality that has within its jurisdiction an abandoned cemetery, or a cemetery not reasonably maintained for more than six months, "may, upon notice to the department" (the Division of Funeral, Cemetery and Consumer Services at the Florida Department of Financial Services), take necessary actions to provide for maintenance and security. She cautioned that the site in question appears to be within the city's jurisdiction and that "maintain and secure" under the statute does not automatically include placing memorial markers.
Commissioners asked the county attorney to include, in the response, practical steps for commissioners and members of the public to check the state cemetery registry and what steps to take if a suspected gravesite is not registered. The board accepted a friendly amendment to receive the attorney's analysis by email first; if further action is available and appropriate, the board can schedule a formal agenda item later. The motion passed unanimously.
