San Miguel County commissioners deferred action Oct. 15 on a request from Pinion Park owner Andrew (last name) to extend an exception that allowed him to keep and rent a deed-restricted Pinion Park unit while it attempts to sell the prior home.
The owner said he had reduced the asking price to attract buyers, but high mortgage rates and buyer qualification gaps have limited offers; he is currently renting the unit to a qualified tenant. Commissioners and county staff discussed prior precedent for limited extensions and noted the county must balance enforcement of deed restrictions with cases involving tight market conditions.
Commissioners asked staff to compute an objective price threshold for resale that would reflect current mortgage rates and eligibility under the deed restriction (e.g., 120% AMI limit) and to return two weeks hence with a recommended minimum acceptable resale price. Commissioner Brown and others said they would prefer a technical calculation rather than an open-ended extension so applicants have certainty and the county avoids repeated extensions.
The board set a follow-up discussion for Oct. 29 (special meeting) to review the recommended price metric and timing for a final decision; no extension was granted Oct. 15.
