Committee recommends approval of operator’s license appeal for Rosemary Fluh; final council sign-off required

The Green Bay Protection Policy Committee on Monday voted to recommend approval of an appeal of the denial of an operator’s license for Rosemary Fluh, with final approval pending at the Common Council.
An attorney for the city explained the original denial stemmed from the applicant’s record: the applicant is on a fourth OWI-related offense count and therefore did not meet the municipal qualification cited as "125.04 sub 5." Police confirmed the most recent offense entry was dated May 28 of this year and that the earlier offenses remain counted under state rules.
Rosemary Fluh told the committee she is the manager at her employer’s bar, has worked for the same manager for about 20 years, is participating in treatment and has an ignition interlock on her vehicle. She said she is trying to remain sober and needs the job to pay bills. ‘‘I would like my license back,’’ Fluh said.
William Baker, who identified himself as the applicant’s employer and owner of the establishment, spoke in support and described workplace restrictions (she is not allowed to drink at work) and the operational importance of Fluh to the business. A city attorney and police officer recommended denial based on the licensing code given the conviction history, but members of the committee emphasized the applicant’s long employment, employer support and recent compliance steps.
The committee voted in favor of the appeal; members noted the committee’s decision is only a recommendation and that final approval will be taken up by the Common Council at its Oct. 22 meeting. The clerk’s office will notify Fluh after the Common Council acts.
