Seabrook approves Caruthers grading and drainage contract after staff flagged bid discrepancies; contractor says price stands

Seabrook City Council on July 15 awarded a not‑to‑exceed $117,431 contract to Itale/Tally Construction for the Caruthers grading and drainage project, after staff reported bid discrepancies and possible improper communication during the bidding process.

City staff told council that one of the bidders had submitted a proposal with mathematical and quantity inconsistencies. Staff said the bidder later told them he had assumed certain scope items — notably removal of 11 trees and relocation of 580 cubic yards of soil — were not required, based on prior discussions with a board member. That left the bidder’s extension prices materially lower than the quantities listed in the formal solicitation.

Staff recommended awarding the contract to the lower, responsible bidder at $117,431, after confirming with the contractor that the work could be performed for the bid price. Angel Guerrero of Italy Construction (listed in the record as the contractor present) said he had inspected the site and believed the trees in question were already removed, and he confirmed, “That price will work.”

Council discussed the procurement irregularity, the need to follow the state’s competitive‑bid requirements and the risk of scope changes after award. The council approved the contract; the motion passed with one recorded opposing vote from Council Member Sanford.

Staff said the city will proceed with the awarded contractor but emphasized that quantities on the bid form will be binding and cautioned about potential change orders if field conditions differ from bid assumptions.
