The Manor City Council approved as-to-form an encroachment agreement with the City of Austin covering a force main that Lennar will place within Manor’s right-of-way. The council authorized the city manager to finalize and execute the agreement after staff completes remaining negotiations.
Assistant City Attorney Veronica Rivera told council the draft encroachment agreement replaces an earlier license approach at Austin’s request and will govern use of the City’s right-of-way by the force main; the force main will be used for the Lennar project and the City of Austin’s system. Rivera said maintenance responsibility is covered in the agreement language under negotiation and that the developer and Austin are negotiating exhibits and some return provisions in the event Lennar does not build.
Council authorized execution of the agreement as to form and directed the city manager to sign once staff and Austin finalize the remaining exhibits and payment/return clauses.
