Councilor Walsh asked why the item would not be heard that evening; the council said it was to allow the parties to resolve outstanding issues.
Councilor Davila asked whether the permit could be split to separate uses on the site (for example, food-truck operations separate from auto-related permits). The council's legal adviser explained that, under law, a special permit notice and petition are for the full petition as noticed; the council can vote to approve portions, deny portions, or condition a permit, but it cannot split a single noticed petition into two votes at different times because public notice was issued for the petition as a whole.
After discussion, the council voted by roll call to continue the matter to Oct. 27 to allow the applicant and staff to address the unresolved issues. The hearing had not been opened when the motion to continue was made, and no testimony on the merits was taken that night.
