The Cannon Falls Planning Commission on Aug. 11 recommended that the City Council approve a preliminary plat to replat lots in the older Terre Haute Saint Clair addition, restoring public alley rights-of-way and clearing the way for future residential construction, contingent on nine conditions.
The recommendation followed a staff presentation and a public hearing during which a nearby resident, Becky Youngmark of 810 Fifth Street North, said she and her husband were "concerned about crowding" and worried that the plan could place "five families into three buildings" on lots she described as small. The applicant discussed infrastructure already in place and said he intends to plat the property so it can be developed in the future.
Staff told the commission that a substantially similar preliminary plat was approved in 2018 but a final plat was never filed; under city subdivision rules, a preliminary plat lapses if not advanced to final plat within one year. Because the 2018 alley vacations were recorded, the current application seeks to re-establish alley right-of-way and conform the site to current alley standards, which staff described as 16 feet of paved surface within a 32-foot right-of-way (16 feet of additional right-of-way, 8 feet on each side). Staff said that requirement, and the presence of existing underground utilities, create dimensional challenges that will likely require variances for lot depth and a front setback on at least one parcel.
The commission discussed timing and uncertainty about whether the applicant will build immediately or simply replat for future development. The applicant said, "I'm gonna plat it, period," and clarified he did not guarantee construction would follow immediately; he said the platting is intended to preserve the land’s buildability for his family or a future buyer. Staff and commissioners emphasized that final plat approval — and any variances — would run with the land if granted at that later stage.
Commissioners reviewed site access and engineering conditions. Staff noted ongoing coordination with MnDOT regarding a relocated culvert and entrance alignment; staff recommended that any MnDOT requirements be incorporated into the final plat documents. Other conditions flagged for final plat included updated grading/drainage and erosion-control plans, a current certificate of survey and utility plans (as-builts were on file from 2018 but need updating), and conforming street/road naming.
After discussion and public comment, Commissioner Chris moved to recommend approval to the City Council, Brian seconded, and the commission's recommendation carried. The commission’s favorable recommendation with nine conditions will be forwarded to the City Council; staff said the council will consider the resolution at its Aug. 19 meeting.
The commission repeatedly cautioned that a recommendation on a preliminary plat does not remove subsequent procedural steps: a final plat, any required variances (which may require separate public hearings), and the building-permit and zoning-authorization steps required before construction. Staff noted final plats do not always require another public hearing but variances do.
Next steps identified in the meeting: incorporate MnDOT feedback and updated engineering documents into the final-plat submittal, resolve any variance requests required by the final design, and submit the finalized materials for the City Council resolution and subsequent final-plat processing.
