The special magistrate heard the matter on Sept. 8, 2025, and issued a signed order with findings of fact and conclusions of law. Under the county’s ordinance governing special magistrates, the board must act within 30 days to either accept or reject the magistrate’s decision. No written exceptions to the magistrate’s order were filed by either the county staff or the applicant.
Legal staff advised the board on the standard of review: the commission may only reject the magistrate’s findings in limited circumstances, such as clearly erroneous factual findings, legal misapplication, or abuse of discretion, and the board may not admit new evidence at this post‑hearing stage.
