The Tippecanoe County Area Board of Zoning Appeals on Aug. 27 approved a variance for Paul Luttrell to reduce the required south/front yard setback from 25 feet to 10 feet for a new shed at 200 Cedar Hollow Court (UZO reference: R1 zone). The board voted with six affirmative ballots and one opposed out of seven cast.
APC staff Nathan McBurnett reviewed the file and noted the house sits above a steep ravine and that the petitioner had already placed a platform for the foundation; staff recommended denial because a tool shed is not required by the zoning district and the hardship test was not met. The petitioner, Paul Luttrell, described site constraints, said the proposed location best protects long‑term site stability and showed the building permit request and sample elevations. A nearby neighbor spoke in favor, describing property stewardship by the petitioner. Board members discussed permanence of a variance (it runs with the land) but voted to grant the variance, finding the practical difficulties justified relief in this case. The vote tally was 7 ballots cast: 6 yes, 1 no; the variance was granted.
What the approval means
The approved variance allows the shed to remain in the approved 10‑foot location; the variance is attached to the property and will continue to apply upon future ownership transfers (a variance runs with the land unless rescinded by future action). Any building permits must still be obtained and required conditions followed.
