The Manor Planning and Zoning Commission on Aug. 13 approved a setback waiver for 210 East Browning Street, allowing the rear setback to be reduced to 10 feet as requested by the applicant T001 Management LLC. The motion passed 4-0.
Staff said the item was added to the meeting backup as a late addition and explained the current standard setbacks in Old Town Manor are stringent (examples cited: 25-foot front, 15-foot side, 20-foot rear) and that the city has allowed setback waivers in similar Old Town parcels. For this application, staff said the current front setback is 20 feet and the applicant requested a rear setback of 10 feet.
A scaled model was brought to the meeting to show how a back patio would encroach into the rear setback; staff and the applicant said the primary house structure does not encroach. Three people — Victor Pena, Luis Carrillo and Tori Overton — were listed as speaking in favor; the meeting records show they were present though only one attendee confirmed being available for questions.
Commissioner Niedler moved approval of the setback waiver; Commissioner Meyer seconded. The motion passed 4 to 0.
The waiver applies to the specific property and does not exempt the project from any other required permits or inspections.
