Committee weighs raising city manager settlement authority; notes state-law constraint at $50,000

Sunnyvale committee members discussed whether residents favor keeping the city manager’s settlement authority at the statutory baseline (a $50,000 limit was cited) or supporting a higher amount, either written into the charter or set by council ordinance.

Deputy City Manager Connie Vercelles summarized that state law limits settlement authority to $50,000 unless a city’s charter provides otherwise. Committee members asked whether the draft survey should present three options: keep the $50,000 limit, increase the limit and put a specific higher dollar amount into the charter, or allow the city council to set and update the limit by ordinance.

Several members favored preserving the state-law explanation in the survey background so respondents understand why this issue exists. Member Vickery and others said the background should be concise but clear that raising the limit without a charter amendment requires a different legal approach. Public speaker Steve S. urged the committee to include clear, plain-language options and recommended giving respondents a set of concrete multiple-choice amounts (for example, multiples of the current limit) rather than just an open-ended prompt.

The committee directed staff to streamline the background text to say that state law currently provides a $50,000 settlement limit for the city manager and that larger limits require a charter amendment or another legal approach. Committee members agreed on a draft set of response options for the survey: keep $50,000; increase and place a specific higher amount in the charter; allow council to set/update by ordinance; or not sure. The committee did not vote on a final dollar figure.
