Supervisors approve San Juan Oaks Phase 2 final map; one supervisor recuses

On Oct. 14 the San Benito County Board of Supervisors approved the final map for Phase 2 of the San Juan Oaks project. The recorded roll-call vote was: Supervisor Colin Kozmicki — yes; Supervisor Zenger — yes; Supervisor Sotelo — yes; Supervisor Velasquez — no; with one abstention (Supervisor Carl recused). The motion passed.
Supervisor Carl announced a required recusal under Government Code section cited on the record after disclosing a campaign contribution of $5,900 from Dustin Bogue of Third Millennium Partnership, a subsidiary with an interest in the agenda item. "Due to being in my campaign mode, per Government Code 84308, I need to recuse myself from item 1.13," he said.
Board briefing materials and remarks during the meeting emphasized this action was not a new approval of the San Juan Oaks development. County staff and one supervisor noted the development agreement was approved in February 2015 and amended in February 2019. County counsel advised the board that once the conditions for the phase were satisfied, the county is statutorily required to approve the final map as a ministerial duty.
A supervisor stressed that approval of the final map does not authorize new homes beyond what the development agreement and prior approvals allow. The board recorded the approval and noted the developer's compliance with the conditions for this phase as presented at the meeting.
