The rule, which the agency said is part of the state Medicaid plan and governs how providers bill for laboratory services, expired on 01/24/2024. Committee members asked whether any fines or administrative appeals had been filed while the rule was expired.
Lisonbee Ratney, administrator for the Administrative Rules Unit, told the committee there were no fees or fines associated with the rule. Sarah Morris, a policy analyst with the Division of Medicaid Services, said providers continued to be reimbursed “as usual” under the state plan and that the agency had not received appeals tied to the lapse in rule text during the roughly 18-month period it was expired.
After brief questions from committee members, a motion to approve the rule was moved, seconded and approved by voice vote.
The committee record shows the rule was considered under regular order after being removed from the consent calendar for committee review. No amendments to the rule text were discussed or adopted during the committee meeting.
