The City Council unanimously adopted Resolution 25‑025R directing staff and the Planning and Zoning Commission to draft a text amendment to the City of Red Oak zoning ordinance that would redefine "new motorcycle sales" to include other powered recreational vehicles such as all‑terrain vehicles (ATVs), side‑by‑sides and, by council amendment, watercraft. The resolution passed 5‑0.
Planning staff told the council the change responds to an inquiry from a landowner and potential business that sought a zoning classification for ATV sales. Staff said current definitions for "new motorcycle sales" in the code specify two‑wheeled vehicles only, and the city's unlisted‑use process required the planning commission to recommend either treating powersports as "new motorcycle sales" or to craft a new definition.
As staff explained, adding powersports into the "new motorcycle sales" definition would not eliminate existing permit or special‑condition requirements. Mr. Hartman, a city staff member, said the modified category "will still require all the same things that new motorcycle sales requires," including any special‑use permit (SUP) required in the underlying zoning district. Staff noted the site under consideration currently is zoned HO and that HO allows new motorcycle sales by SUP.
Council members confirmed with staff that the applicant’s land is currently vacant and that the applicant indicated they do not currently sell watercraft; the council voted to add watercraft to the drafting directive so staff would consider inclusion of watercraft in the new definition. Council moved and seconded the resolution with the friendly amendment to include watercraft; the motion passed unanimously.
What happens next: Staff will draft a proposed ordinance language and take it to the Planning and Zoning Commission for public hearing and recommendation, then return to council for a final ordinance if the commission recommends adoption.
