The Red Oak City Council voted 4-0 to deny a developer petition seeking city consent to create the Rocket Ranch Municipal Utility District (MUD) in Ellis County. Legal staff said the proposed district is wholly inside the city’s extraterritorial jurisdiction (ETJ) and that the petitioner is Century Property Acquisitions LLC.
City Attorney (legal staff) explained that cities may be asked to consent to the formation of municipal utility or special utility districts when they are located within city limits or ETJ. Staff recommended opposing the creation of Rocket Ranch MUD based on the city’s past experience with such districts, and the resolution authorizes the city manager to take reasonable steps to oppose the petition, including, if necessary, participating in proceedings before the Texas Commission on Environmental Quality (TCEQ).
