The session was held pursuant to Colorado Revised Statutes section 24-6-402(4)(b), which the board cited as authority to confer with counsel on pending litigation. Board members read a motion to enter executive session that included the statute and the federal-case reference.
“I move that we, the Board of Education, may proceed into executive session pursuant to CRS 24.6402.4B for the purpose of conferring with the attorney for the Thompson School District R2J to receive legal advice on specific questions regarding a proposed settlement in the matter of Bernard v. Thompson School District R2J in the United States District Court, Colorado case number 24CV03110,” a board member stated when making the motion.
The motion was seconded and the board said it would meet in Room 132/135 with district counsel identified as Todd and Bob Ebersol present. The board later reconvened in open session and stated that no action was taken during the executive session.
Following the reconvening, the board indicated it would leave again to have dinner with the town council and return at 6 p.m. to begin the scheduled public meeting.
