Kootenai County commissioners approve HR review to reclassify judicial staff attorney to ATP 2

Kootenai County commissioners voted Oct. 16 to allow county staff to work with human resources on a possible reclassification of the judicial staff attorney position from ATP 1 to ATP 2, after a presentation by Lisa Cheesbrough.
Cheesbrough told the commission the request is intended to update the job description to attract applicants for a vacancy that has been open since Sept. 3 and to address classification concerns for existing judicial staff attorneys. "This is a request to be able to speak with HR regarding, a potential reclassification of the judicial staff attorney position currently listed as an ATP 1," she said.
Cheesbrough said the principal difference between ATP 1 and ATP 2 is bar passage: ATP 1 historically did not require passage of the bar, while ATP 2 does. She said the current judicial staff attorney job descriptions, including the vacant position, require applicants to have passed the bar.
Commissioners asked for clarification on qualifications; Cheesbrough noted the county’s ATP 1 designation (used in other offices) can be for someone who has not yet passed the bar, while ATP 2 requires bar passage. She said the vacancy has produced only one qualified applicant since Sept. 3.
The commission made a motion to allow county staff to work with HR to rework the job description and return to the commission with the HR analysis. The vote recorded three ayes and the motion carried.
The commission did not adopt a final reclassification or change the job posting at the Oct. 16 meeting; Cheesbrough said the analysis will be returned to the commission for further action.
