Summary
New operators of a former auto‑body shop at 1034 Route 109 told the ZBA they took over the business in March 2025 and now seek to renew a special exemption permit; board left the record open pending fire marshal review and agreed covenants.
Cole Gartner appeared on behalf of a new operator, Northstar Auto Body, seeking to continue operation at 1034 Route 109 in Lindenhurst (application 25‑159). Gartner said the previous owner had been approved by the board in 2020 to operate a public garage (auto body and auto glass). The new owner took over in March 2025 and applied to renew the special exemption; the operation now would be Northstar Auto Body, which operates four locations in Nassau County.
The applicant explained there have been no structural changes to the site aside from painting and that the business informed the town when it learned that a permit renewal was required. The chair noted there are outstanding items in the fire marshal’s report that must be addressed. The applicant’s principal, Anthony Gigante, confirmed that customer vehicles are currently left outside overnight behind fencing and that employees’ vehicles are parked in front; the board advised that outside vehicle storage must be shown on the site plan and permitted as such.
The owners agreed to the standard covenants and restrictions for a public garage that the planning board had previously used; the fire marshal’s outstanding comments must be addressed before the board makes a decision. The ZBA closed public comment, reserved decision and left the record open for the applicant to respond to the fire marshal and submit any missing documentation. The board will mail the written decision after the outstanding items are resolved.
