Zoning board approves second‑floor family addition at North Babylon home

The Town of Babylon Zoning Board of Appeals approved an application on Sept. 25, 2025, for a second‑floor addition to a single‑family home at 79 Kyme Avenue in North Babylon. The board voted to approve application 25‑163 after the applicant’s representative described the project and the board took no public objections.

The applicant’s attorney, Gennaro Cozzolino, told the board the project would add two bedrooms, a full bathroom and laundry on a second floor built over the current footprint and that the house will remain a single‑family, owner‑occupied dwelling. Cozzolino said the proposal requires relief from the side yard setback and the aggregate side yard setback: “requesting 10.5 feet instead of permitted 12 feet” and aggregate side yard “requesting 20.4 feet instead of permitted 30 feet.”

Planning and town department memos were entered into the record. The board chair confirmed the addition “is to be built over the existing footprint of the dwelling, not encroaching any further into the side yard setbacks.” No members of the public asked to speak on the matter. A motion to approve application 25‑163 was made and seconded; the board recorded affirmative votes and approved the project.

The board discussed no conditions beyond the normal building‑permit process; the chair reminded the applicant that a building permit from the Building Department is required before construction begins. The applicant confirmed the proposed work would comply with other zoning requirements and the Planning Division’s comments.

The decision will be issued in writing to the applicant. Plans and final permits must be obtained from the Town of Babylon Building Department before construction may begin.
