Depew Zoning Board approves 3-foot driveway setback variance for Bird family

The Village of Depew Zoning Board of Appeals voted 5-0 on Sept. 25 to grant a variance allowing James and Patrick Bird (represented at the hearing by Patricia Bird) to widen a driveway at 88 Murano Drive within the three-foot setback required by the village ordinance.
Patricia Bird told the board the widening is intended to provide more room for off-street parking during winter months because family members have returned home. "Just wanna get it done," she said during the hearing. A staff member told the board he inspected the site and confirmed measurements.
The board read the applicants written answers to New York States six criteria for area variances. The applicant answered that the change would not be undesirable to neighborhood character ("no"), could not be achieved by other methods ("no"), the request was not substantial ("no"), it would not adversely affect physical or environmental conditions ("no"), the alleged difficulty was self-created ("yes"), and the minimum relief requested was three feet.
Member Yarbrough moved to grant the variance; Member Galvin seconded. Roll call votes were recorded as yes from Member O'Hollt, Member Galvin, Member Menard, Member Yarborough, and Acting Chairman Patrick Delaney. The motion passed, 5-0. The board then closed the public hearing.
