The Maricopa County Planning and Zoning Commission on Sept. 25 voted 8-0 to recommend approval of Z240024, a request to rezone roughly 1 acre at the northeast corner of Willis Road and 140th Street from Rural‑43 to C‑2 CUPD to allow an HVAC office/dispatch facility and a proposed 6,000‑square‑foot shop.
Planning staff described the request as a transition of the site from a former single‑family residence to a low‑intensity commercial use that includes an overlay (CUPD) to modify development standards for setbacks and paving and to limit permitted uses. Staff said it had received no public opposition but noted the Town of Gilbert submitted a written objection stating the proposed indoor workshop does not conform to Gilbert’s general plan designations for the area.
Jessica Sarkissian of Upfront Planning, representing the applicant Hickin Air, told the commission the site address is 17545 South 140th Street and described the company as a family‑owned HVAC service that has operated in the region since 2009. She said previous code‑violation issues on the property had been addressed by the current owner, including removal of unpermitted structures and cleanup.
Sarkissian presented maps showing the site’s proximity to the Loop 202 Santan Freeway and the adjacent business‑park zoning within incorporated Gilbert. She said the applicant seeks a limited set of C‑2 uses and deviations only where necessary due to right‑of‑way acquisitions and existing building placement, and that proposed development standards are intended to match the transition already occurring along 140th Street.
Commission discussion noted the Town of Gilbert’s written objection; Chairman Lindblom said the commission does not take such opposition lightly but had no representatives present from Gilbert to answer questions. No members of the public testified in opposition at the hearing.
Commissioner Hernandez moved to recommend approval subject to conditions A–G in the staff report; Commissioner Rockwallick seconded. The commission recorded an 8‑0 roll‑call vote recommending approval.
Staff advised that approval is subject to the conditions contained in the staff report and paragraph 15; the recommendation advances the rezoning to the next stage of county review.
