County counsel briefs veterans council on Brown Act public‑meeting rules

Eric Havens, Imperial County counsel, gave a presentation on the Ralph M. Brown Act and how it applies to advisory bodies, covering meeting definitions, exceptions, agenda requirements, public participation, and remedies for violations. He advised the VAC to post agendas at least 72 hours before regular meetings, explained the limited circumstances for adding urgent items after posting, and cautioned members against serial communications that could create a quorum outside public meetings.

Havens walked members through common exceptions (conference, social/ceremonial occasions, community meetings, and ad hoc committees) and the risks of a quorum congregating informally. He recommended that members avoid expressing views on pending items outside the dais and suggested practical steps when constituents call: listen, avoid sharing other members’ views, and defer decision-making until the public meeting. He also advised separating seating at public events to avoid the appearance of deliberation among a majority.

Havens offered to provide the VAC a copy of the Brown Act materials he used and suggested the clerk of the board could host a VAC subpage on the county website to host agendas, minutes, bylaws and audio. Council members asked clarifying questions about public comment timing, special-meeting notice (24 hours), and the supermajority standard for adding urgent items that arise after agenda posting. Staff said they will add a social-media policy and consider a follow-up presentation by the county’s communications staff.
