The Board of County Commissioners unanimously approved a first amendment Sept. 23 to an intergovernmental agreement clarifying responsibilities for permanent water-quality facilities associated with the C-470 tolled express lanes design-build project (segment 1).
Staff presented the amendment as the anticipated follow-up to a 2016 agreement. The Colorado Department of Transportation used a design-build procurement method and did not have final facility plans in 2016, prompting an amendment to identify final deeds and to confirm which features CDOT would maintain and which remain the responsibility of Highlands Ranch Metropolitan District. County staff said the Highlands Ranch Metro District saved the project millions of dollars by taking responsibility for certain ponds and water-quality improvements where CDOT had limited right of way.
County role: Douglas County’s involvement stems from MS4 (municipal separate stormwater system) permit requirements; staff said both CDOT and the Metro District must adhere to county standards. County staff said the county’s responsibilities are primarily notification for emergencies (such as spills) but not routine maintenance of the facilities.
Action taken: The board moved to approve the first amendment and the motion carried unanimously. The amendment memorializes the final plan allocations and aligns county MS4 oversight with CDOT’s and the Metro District’s duties.
Next steps: With the amendment approved, staff said CDOT and the Metro District will proceed under the clarified responsibilities; no additional county budget action was presented at the meeting.
