ATHENS, Ala. — The Athens City Council on Sept. 22, 2025, unanimously approved an ordinance annexing about 3.68 acres owned by JHH Properties LLC near the intersection of Huntsville Brown Ferry Road and U.S. Highway 31 and set a public hearing for Oct. 27 to consider rezoning the property to B-2 General Business District. Council and planning staff said the planning commission reviewed the annexation and saw no issues, and staff told the council that a private developer has expressed interest in the site. The annexation ordinance passed by roll call, 4 yeas, 0 nays, and the resolution setting the zoning public hearing for Oct. 27 also passed 4-0. During public remarks, a resident, Scott Marshall, questioned the timing and process of placing annexation and zoning items on the council agenda and said citizens would prefer more pre-meeting information; council members responded that the planning commission was aware of the annexation and that the process used was consistent with prior practice. Aaron Tidwell, city planner, shared maps and described the parcel as fitting into the city's plan for a B-2 corner and commercial development.
