Douglas County commissioners on Sept. 23 approved a replat of Crestview Filing 1 that divides a single 11.4-acre residential lot into two lots of 6.38 and 5.02 acres and allows the lots to share a single groundwater well under a recorded shared-well agreement. The board approved the replat with multiple conditions staff recommended, including plugging the existing exempt well and completing a new well permit prior to recordation.
Why it matters: The replat creates one additional building lot in a rural residential area while relying on groundwater; Division of Water Resources required the applicant to plug the existing exempt well and complete a new well, and the county required a recorded shared-well agreement and easements.
Staff presentation and conditions: Trevor Bedford, planning staff, said referral agencies raised standard comments and that the Colorado Division of Water Resources required the existing exempt well be plugged and a new well completed before recording the plat. Staff recommended eight conditions prior to recordation, including plugging and abandoning the existing exempt well (to the satisfaction of the Division of Water Resources), recording a shared-well agreement and associated easements, payment of cash-in-lieu fees for schools ($500 per unit) and parks ($250 per unit), and other technical corrections and required recorded instruments.
Applicant remarks: Bruce Williams, the property owner and applicant, told the board the family wants to subdivide the parcel so he and his wife can build on one lot and remain near their adult children; he said the HOA committee had reviewed the proposal and had been supportive. Jason Mead (son) spoke briefly about the family and why they seek a multigenerational arrangement.
Board discussion and vote: Commissioners noted the proposal met approval criteria and discussed the shared-well approach; staff said the shared-well agreement provides easements and allows lot 23B the option to drill a separate well in the future. A commissioner noted he had not previously seen a shared well in a platted subdivision in the county but that the Division of Water Resources had no objection. The board approved the replat unanimously with the eight conditions.
Clarifying detail: The new well permit number cited in the staff conditions is 10044232 and will serve the existing home. The shared-well agreement must be signed and recorded and would bind successors; the agreement allows the owner of the lot without immediate well access to drill a separate well later if desired.
Ending: With the conditions satisfied and the new well permitted and completed, the plat may be recorded and the applicants will be able to proceed with building under the county's subdivision rules.
