The Board of Zoning Appeals voted Dec. 22 to approve a developmental variance allowing petitioner Craig A. Cutler to build a three‑season room that would extend 7½ feet beyond the 30‑foot building line on a corner lot at 630170 Fourth Place in Autumn Creek. The board approved the motion by roll call; Bill Jarvis, Tom Korris and Michael Davis voted yes and the motion carried.
Cutler told the board he sought the variance because the corner lot is “narrow and irregularly shaped,” which he said limits placement of backyard additions. “I am here tonight to respectfully request a developmental variance,” Cutler said, describing a proposed addition he characterized as modest in scale and intended for seasonal use. He said the structure would be unheated, have no plumbing and would not be used as a bedroom.
The record shows Cutler described the proposed structure as “14 foot by 10 foot, 10 foot 11 sixteenth inches” (text unclear in the record) and said the variance request is to allow a 3‑season room to encroach 7½ feet over the building line. He told the board he removed an existing fence and deck after closing on the property earlier in the year and said those prior structures had been in place about “16 years or 18 years,” which he cited as context for his hardship claim. He also said the builder’s kit for the room has been used by the builder “thousands of times” and that the project would be constructed “according to all applicable building codes.”
Board members asked whether the prior fence and deck remained (Cutler said they had been removed) and whether utilities or easements would be affected (Cutler said no). After board questions and no audience comments, Board of Zoning Appeals member Bill Jarvis moved to approve the variance “pursuant to all state, local, federal regulations.” Tom Korris seconded; a roll call produced affirmative votes from Jarvis, Korris and Michael Davis, and the motion was approved.
The variance approved permits the construction as described in the petitioner’s submittal. The record does not include subsequent building‑permit actions or inspections; any required permits or inspections would follow the town’s normal permit process.
