The Brockton Conservation Commission reissued an enforcement order on Wednesday for 58 Trout Street, restoring a 2022 order that had lapsed and directing the property owner to comply with prior requirements to file a notice of intent for work in floodplain and wetland areas.
Agent Kyle Holden said the original order, issued July 25, 2022, required the owner to file a notice of intent because activities on the property — including construction of yard features and expansion of fenced yard area — occurred within bordering lands subject to flooding. Holden told the commission that the matter had not advanced and recommended reissuing the enforcement order with the same timetable as the earlier order so the owner would file the required materials and either permit or restore the work.
Owner Lucio Pena (attended the meeting) and another attendee acknowledged prior communication with building and fire staff and said the pool (installed earlier in 2025) had been removed and a portable fire pit taken out after staff raised concerns. The owner said he would cooperate with staff and follow instructions in the new enforcement order. Commissioners voted to reissue the 2022 enforcement order with updated dates.
