The Select Board and Nantucket County Commissioners voted Sept. 17 to accept conveyance of parcels along Tom Nevers Road from the Massachusetts Department of Transportation and to consolidate ownership of the 60-foot road layout, clearing a title split that had left parts of the layout in MassDOT ownership.
Why it matters: Consolidating ownership removes a legal obstacle to planned roadway and multiuse-path improvements and allows the town’s transportation planner to proceed with design work for a Tom Nevers bike path.
Real-estate staff said research showed the road was laid out as a public road in 1956 and that subsequent records left portions titled to MassDOT while other portions were town-owned. Town counsel negotiated a release deed transferring MassDOT’s right, title and interest in the parcels to the town; the Select Board moved and unanimously approved acceptance of the deed, then approved execution and a conveyance deed consistent with other town/county roadways. The county commissioners then accepted the deed in their separate meeting, a step presenters said would streamline ownership and allow the transportation planner to move forward with design references for the bike path.
Board votes: The Select Board voted unanimously by roll call to accept the release deed from MassDOT and to approve and execute the town’s conveyance deed; the County Commissioners voted unanimously to accept the deed on the county’s side.
Ending: Town staff said the deed consolidation will help Mike Burns, the town transportation planner, proceed with Tom Nevers bike-path design work and that subsequent design and permitting steps will follow.
