Counsel told the commission the owner was delayed returning from travel and offered to answer questions but commissioners said prior complaints about entertainment volume and the location’s highly residential setting required the owner’s direct participation. A commissioner said the issues were “not necessarily directly related to how your client has operated the business itself” but instead related to the venue’s location and the crowd and music it attracts.
The commission agreed to reschedule the matter for the next hearing (the third Wednesday in October) and asked counsel to have the owner present to address operational and noise-control questions on the record. The applicant’s notice affidavit previously submitted to commission staff was accepted as sufficient for re-notification.
