Lattimore reported the city's planner reviewed the lot-split materials and concluded the split could not be approved because required setbacks could not be met; a withdrawal letter from the planner was placed in the case file.
Given that the lot split could not proceed, Lattimore said, paving the driveway became necessary to meet on-site parking requirements for single-family occupancy. The magistrate adopted the officer's recommendation and gave the respondent 90 days to complete paving; failure to do so will trigger a $50-per-day fine.
