Murray RDA approves amended development agreement allowing condos to be replaced with medical offices

The Redevelopment Agency of Murray City on Thursday approved an amendment and restatement of the real-estate purchase, sale and development agreement with Triumph Group Murray LLC that allows the developer to replace planned condominium units on the old City Hall block with a new medical office building and consolidates previous amendments into a single recorded document.
The change was requested by the developer and presented to the agency as a material amendment to the Block 1/old City Hall project. Agency staff said the restated agreement folds three earlier amendments and the new change into one document that will be recorded against the property. Chad Wilkinson, representing Triumph Group Murray LLC, told the board the developer is completing construction drawings for the medical office building and that a building-permit package for the State Street building must be submitted by October 3.
The amendment removes the previously required condominium units on the southeast portion of the site and replaces them with medical-office space located behind the State Street tower. Wilkinson described the replacement building as “about the same” height as the other proposed medical office buildings in the project and said grade differences will affect apparent height. Staff showed renderings comparing the originally approved condominium towers and the proposed medical-office replacement and said the revised drawings will be attached as an exhibit to the restated agreement so the change is explicit in the recorded document.
The board approved the amendment on a roll call vote with all attending members voting in favor. Brooke called the roll: Mister Hawk — aye; Mister Pickett — aye; Miss Cotter — aye; Mister Goodman — aye; Miss Turner — aye. The resolution passed and staff said the restated agreement will be recorded and conveyed to the developer as part of the Block 1 transaction.
Agency staff stressed the amendment does not remove other existing deadlines in the agreement. Wilkinson emphasized the firm deadline for submittal of the State Street building permit, saying, “that date is the set in stone date for the submittal of the building permit package for that State Street Building.” The board and staff noted that other timeline elements in the agreement remain in force after the restatement.
What's next: the restated agreement will be recorded against the property and the developer must submit the permit package for the State Street building by the October 3 deadline included in the agreement. Agency staff said they will circulate the final exhibit package showing the replaced condominium towers and the new medical-office building to the board once the developer completes the detailed construction drawings.
