Eden Prairie — The City Council on Sept. 16 closed a public hearing and adopted a resolution vacating drainage and utility easements on Lot 1, Block 2 of the Aztec Drive addition, conditioned on recording the new plat for the Aspen Estates assisted‑living and memory‑care development.
City staff explained the action follows prior council approval of the Aspen Estates development. City staff said the prior easements will be released and new drainage and utility easements will be dedicated on the new plat; the release will be "conditioned on the recording of the plat of the new project." Staff described the vote as a routine, post‑approval housekeeping item after platting.
The council opened the public hearing, asked whether anyone from the audience wished to speak, heard none and moved to close the hearing. A council member moved to "close the public hearing and adopt the resolution," another council member seconded, and the council approved the resolution by voice vote. No roll‑call vote was recorded in the meeting transcript.
Discussion versus action: the item was procedural—staff sought formal adoption of a resolution to vacate existing easements contingent on recording the new plat. There was no public testimony and no substantive debate recorded. The council expressly conditioned the easement release on the recording of the new plat.
Next steps: staff will record the plat and, upon recording, process the release of the specified drainage and utility easements per the adopted resolution.
