County discusses 30-day appointment window for tribal Board of Health seat

County commissioners held a preparatory discussion Tuesday about how to handle an upcoming tribal appointment to the regional Board of Health after receiving word that the Native Project intends to submit a formal nomination. County staff proposed updating the county resolution to allow 30 days from receipt of the tribe’s letter for the county to name its appointee; staff said that approach would avoid rushed decisions and is lawful under state rules.

Michelle Fosam, attorney for the health district (present at the briefing), and county staff noted the revised resolution would clarify timing and provide a reasonable window for the board to vet candidates. The briefing clarified that state rules (WAC/WACC referenced) include ambiguities; county staff reported the WAC provides up to 60 days in one reading, and that adopting a local 30-day window is a lawful and cautious interpretation. Commissioners discussed which board members might serve if the appointment is imminent. Commissioner Jordan said he is happy to serve; other commissioners noted scheduling conflicts could affect availability.

No formal appointment or vote occurred. Staff said they will circulate a draft resolution for review and will be prepared to act quickly if the Native Project’s letter arrives. County staff also said the county must consider the statutory requirement that tribal appointments and the county’s own appointees be coordinated so that membership balances correctly before a tribal member’s appointment becomes effective.
