Methuen School Committee members raised legal questions about the district’s updated nondiscrimination and harassment policies during a detailed policy review on Sept. 16.
Several draft policies were presented from the Massachusetts Association of School Committees (MASC). Member Maxwell pressed for clarity about where phrases such as “sexual orientation” and “gender identity” derive from and whether they fall under Title IX or state law. “Where does … gender identity fit into this? I’m pretty sure that language would be different from the law,” Maxwell said.
Members and staff said the MASC drafts reflect a combination of federal and state authorities and that the district will defer to legal counsel to confirm precise citations. Meeting discussion noted a recent federal court ruling that affected Title IX guidance and an earlier state action; members asked the superintendent’s office and counsel to identify the controlling legal authority before the final adoption.
No final policy language was adopted at the meeting. The committee marked nondiscrimination and harassment sections for follow‑up and asked staff to coordinate a legal review and to bring clarified citations and recommended text to the next meeting.
