Policy committee forwards technical edits to ACF to align with reinstated 2020 Title IX regulations

The Policy Management Committee on Sept. 16 voted unanimously to forward technical amendments to board Policy ACF to align its language with the Title IX regulatory framework currently in effect.
Staff explained that the U.S. Department of Education’s 2024 Title IX regulations briefly expanded the definition of protected conduct; subsequent litigation led to the district court vacating the 2024 rule and reinstating the 2020 regulations. As a result, staff proposed technical edits to ACF that revert terminology introduced in 2024 (for example, returning from the 2024 phraseology back to the 2020 definitions where the policy had quoted the federal rule).
Robin Seabrook, chief of legal services, told the committee that the amendments do not change the district’s broader nondiscrimination commitments under board policy ACA or the protections in the JHF regulation addressing bullying, harassment and intimidation. “Importantly, these technical amendments do not change the board’s broader commitment to discrimination protections,” Seabrook said.
The committee moved and seconded the technical amendment and approved forwarding it to the full board unanimously.
Next steps: the committee forwarded the amendments to the full board for final action. Staff characterized the edits as technical language alignments to current federal regulatory requirements; they recommended no additional public-comment period for these technical changes.
