The La Porte Board of Public Works and Safety approved a settlement agreement with DHS LLC (doing business as the affected business) resolving valuation and relocation-cost disputes arising from an eminent domain acquisition tied to a planned overpass and related improvements, staff said. The board approved the agreement at its Sept. 16 meeting.
Staff described the settlement as resolving disagreement over commercial valuation and relocation costs for the business owner, and said the City Council appropriated funds at its previous meeting to allow an initial payment. "Last night, the City Council appropriated, major move funds to make the payment the first payment of $200,000 for this and then the second payment would be made on or before 03/30/2027," a city attorney/representative said during the meeting.
Nut graf: The settlement covers both a valuation component and relocation costs; staff said construction for the overpass has progressed toward construction and that the settlement will allow right-of-way acquisition to proceed.
Council and staff also discussed the character of the neighborhood and the city's efforts to improve the Clear Lake area. The motion to approve the settlement passed unanimously on the board floor.
Ending: The first payment will be made from council‑appropriated funds; staff said the second payment is scheduled on or before March 30, 2027, as specified in the agreement.
