Hearing continued for large multiunit at 218 Flax Hill while owner’s counsel seeks administrative resolution

Staff said the property owner retained attorney Gene Kimmel and the owner’s daughter is engaged in communications with the city; attorney Kimmel has requested time to negotiate an administrative resolution.
Because counsel for the property participates in related enforcement roles elsewhere in the city, staff and the hearing officer noted and considered possible conflicts; counsel indicated willingness to proceed administratively and, if needed, to appear at a hearing. Given the size of the building and the owner’s representation, the hearing officer continued the matter to Nov. 12 to allow counsel and family representatives to work with staff toward a resolution. No fine was imposed at this hearing.
Speakers included the hearing officer, city staff and representatives for the property owner; staff emphasized that two possible resolution paths exist and urged the owner to work with counsel and zoning staff to produce a remediation plan.
