Zoning staff reported on Sept. 17 that the illegal apartment in the attic and the unauthorized unit in the detached garage at 26 Magnolia have been vacated. Inspectors verified the spaces were empty, and the property owner reported that work to render the spaces nonresidential has begun.
City staff told the hearing that remediation work has started and building permits are in progress, but inspectors have not yet conducted the required follow-up inspections. Zoning advised the owner to coordinate with the building department to schedule inspections and to provide photos and documentation to the zoning file.
The hearing officer found that the violation continues but acknowledged satisfactory progress; he continued the matter to Nov. 12 and set a contingent $5,000 fine if the owner does not demonstrate progress by that hearing date.
Speakers included property owner Mohammed (who testified), the hearing officer and Deputy Zoning Inspector John Hayducki. The owner was advised to email inspection photos and contact the building department to arrange pending inspections before the November hearing.
