Legal director finds spot-zoning for Conestoga huts unlikely to survive challenge, delaying temporary housing plans

A neighborhood resident and attendee reported the city law director assessed a proposed spot-zoning change to permit three Conestoga huts for temporary housing at the Gathering Place on North Congress Street and concluded it would likely not withstand legal challenge. "I just saw the law director's assessment of the coat spot zoning to allow the the, gathering place to have 3 Conestoga huts in the parking lot, next to their building on North Congress Street. And, looks like that's not gonna fly. So I don't think it's gonna be coming before council," resident Rob Delich said during public comment.

He said that even in the best-case scenario the earliest such temporary housing at the Gathering Place would be "probably January or February at the earliest." The law director's proposed scope of review for the service safety director's approval was described as focused on sanitation rather than overall land-use impacts.
