Jackson County approves amended Dittmer Recycling contract with higher insurance and clarified signatories

The Jackson County Board of Supervisors approved an amended contract with Dittmer Recycling on Sept. 16 that raises the contractor's umbrella/excess liability requirement to $4,000,000 and clarifies authorized signatories for both parties. The board un-tabled the item and voted to approve the contract as amended.
The change to insurance was discussed in the meeting with county counsel John Keyes and county staff. Keyes said the umbrella/excess liability limit of $4,000,000 was included in the version the county staff had sent to Dittmer on Sept. 9. Auditor's-office staff read the contract language showing section 5.01(c) now specifies an umbrella/excess liability of $4,000,000. Board members and counsel also discussed the contract's section 11.07 on authorized representatives. The amended language identifies Dittmer's signer as "Scott Dittmer or authorized agent" and the county representative as "any Jackson County supervisor member upon due authorization by the board." Counsel and supervisors discussed whether that phrasing requires formal board approval for a supervisor to act as the county's authorized signer; board members said the intent is that a supervisor must have board approval before acting as the county's signatory.
The board also confirmed that Dittmer Recycling's corporate paperwork shows Scott Dittmer and Joseph (Joe) Rettenmeyer as registered principals and that Shelley Atkinson is an authorized signatory for the company. The supervisors asked that both partners be named in the contract so the company can designate which partner or agent will sign on its behalf.
After clarifying the insurance limits and the signatory language, the board moved to un-table the contract and then approved the amended contract. The board directed county staff to print the corrected version and execute signatures after the meeting.
The amendment affects the county's recycling services contract and was presented as a standard contract-management item rather than new policy. No new budget appropriation was required for the amendment. The board's formal action was to approve the amended contract as presented.
