The Delray Beach City Commission approved a quasi-judicial resolution Sept. 15 to abandon a roughly 50-by-27-foot unimproved section of right-of-way adjacent to 300 Grove Place. The applicant owns the nearby parcels and sought to consolidate the area into a single lot for development; staff recommended approval with conditions to protect utilities.
What staff, applicant said: The applicant’s representative, Jeff Costello of JC Planning Solutions, described the abandoned area as an unimproved dead-end portion of Northwest Second Avenue that functionally belongs to adjoining Grove Estates. Planning staff and the city’s engineering division recommended conditional approval; the applicant agreed to convey a 12-foot east-side water and sewer easement so utilities remain accessible.
Why it matters: Abandonments of unused right-of-way must preserve public utilities and not impede connectivity. The commission’s approval follows the Land Development Regulation criteria and a 6–0 Planning & Zoning Board recommendation.
Decision: After a public hearing with no public speakers, the commission voted to approve Resolution 152-25 and the related water and sewer easement agreement.
