The village board on Monday approved an ordinance rezoning three parcels at 43 West 461, 43 West 427 and 43 West 407 U.S. Route 20 — collectively described in the meeting as the Appleburg property — from R-1 residential to C-1 planned unit development. President Kubiak presided over the vote after staff described the change as aligning the parcels with adjacent commercial zoning and the village comprehensive plan.
Staff member Nick told the board the parcels were annexed in 2008 and retained an R-1 classification despite formerly being zoned for business in Kane County. "Staff believes a commercial 1 planned unit development classification better aligns with the future commercial planning of the surrounding area as well as more accurately reflect the current use of the property," Nick said, and noted the Planning and Zoning Commission had unanimously recommended approval.
The rezoning will reclassify the three lots to the village's C-1 planned unit development designation; any future commercial developer would still need to pursue the PUD process required under village code. Board discussion focused on avoiding confusion for prospective buyers — including a concern that a buyer could occupy a lot residentially — and on clarifying that a PUD designation makes the commercial path clearer for developers.
A motion to approve the ordinance carried on the board's roll call. Trustees who recorded "yes" during the roll call were Trustee Tarnow, Trustee McCurdy, Trustee Hake, Trustee Hall and Trustee Peony. The ordinance passed; no further direction or conditions were recorded in the meeting minutes.
The rezoning aligns the parcels with the village comprehensive plan's commercial corridor designation for the town's western side and follows the Planning and Zoning Commission's unanimous recommendation.
