District staff say new special-education confidentiality policy aligns with state monitoring requirements

The Policy Review Committee reviewed a new Policy 113.4 on confidentiality of special-education student information at its Sept. 15 meeting. District staff said the policy was added to satisfy corrective-action and cyclical monitoring requirements and to align with guidance from PDE and PSBA. Dr. Bukowski, a district staff member, said the information in the new policy largely duplicates provisions already in Policy 216 (Student Records) but was requested by the special-education monitor because the earlier policy did not explicitly reference special-education students. "We had all of this in policy 216, but because it wasn't in this specific policy, the special-education monitor said it doesn't specifically address special ed students even though it addresses all students," Dr. Bukowski said. Committee members confirmed Policy 216 remains in force and is referenced in the legal references for the new policy. The committee directed that Policy 113.4 be posted for public review as part of a group of revised policies; no final adoption occurred during the meeting.
