Board approves Seeds of Early Learning Academy special-use permit; amends code to grandfather nearby dispensaries

The North Aurora Village Board on Sept. 15 approved a special-use permit for a day-care center called Seeds of Early Learning Academy to occupy an existing office building at 181 South Lincoln Way, and approved a zoning amendment clarifying how cannabis dispensaries are treated when a daycare locates nearby.
Adam Ford, a village staff member, said the daycare expects 60 to 100 children at full enrollment with 12 to 15 regular staff and anticipated operating hours of 6 a.m. to 6 p.m., Monday through Friday. "They would take the whole space, the existing office building that's there, and there's plenty of parking, meets code for all of that," Ford said. The planning commission approved the special use on Aug. 6.
During review staff also identified that the village code prevented dispensaries from locating next to daycares, but did not explicitly allow a dispensary that was already in place to remain if a daycare later located next door. The board passed an amendment so that a dispensary that pre-existed a daycare would be grandfathered and allowed to remain in place.
The special-use permit and the zoning amendment passed on separate motions; both were approved by roll-call votes. Village staff said the daycare space meets parking and code requirements and that the code change clarifies local land-use expectations when conflicting uses are adjacent.
