County Attorney Kate LaTour updated the board on the Rivercross litigation during the Sept. 9 meeting and reported the county has a federal‑court judgment for attorney’s fees in the amount of approximately $432,000. LaTour said the county has an open insurance claim; the insurance company informed the county it will pay roughly $417,000, which covers most of the judgment but does not cover accrued post‑judgment interest.
LaTour said post‑judgment interest accrues daily by federal statute and would be recoverable in theory, but she estimated the interest to date at roughly $45,000–$50,000 and warned that further collection efforts (including outside counsel) would likely cost more than the interest itself. Commissioners discussed the options and concluded pursuing the post‑judgment interest further would not be a prudent use of taxpayer funds given the costs involved. The board gave staff direction consistent with that approach.
